Ghar.auction is an information intermediary. This service does not conduct auctions, does not accept bids, and does not collect Earnest Money Deposits (EMD). We are not affiliated with any bank, financial institution, or government body unless explicitly stated.
1. Nature of Service
Ghar.auction provides a discovery and research platform for distressed real estate assets in India, primarily those being auctioned under the SARFAESI Act, 2002, or by order of various courts and tribunals. Our service includes data aggregation, curation, and the provision of contextual information to assist users in their discovery process.
You acknowledge that the information provided on the platform is sourced from public notices and third-party bank announcements. We do not guarantee the availability of any property for auction, as banks reserve the right to withdraw or postpone auctions at any time without notice.
2. No Bidding Guarantee
Registration of interest on ghar.auction does not constitute registration for the actual e-auction. Actual bidding takes place on authorized third-party portals. We do not guarantee that you will be able to successfully register for or participate in any auction. The discretion to accept or reject a bid lies solely with the Authorized Officer of the respective bank.
3. Limitation of Liability
To the maximum extent permitted by Indian law, ghar.auction, its directors, and employees shall not be liable for any direct, indirect, incidental, or consequential damages arising out of:
- Inaccuracies or errors in listing data.
- Loss of EMD or any financial loss incurred during an auction.
- Legal disputes between the buyer and the bank or borrower.
- Failure to obtain physical possession of an auctioned property.
- Temporary unavailability of our platform or data refresh delays.
4. User Responsibilities
As a user of ghar.auction, you agree to:
- Independent Verification:Independently verify all property details, legal titles, and encumbrances with the respective bank branch and the Sub-Registrar's office.
- Physical Inspection: Visit the property site to assess the physical condition and possession status before bidding.
- Legal Counsel: Seek independent legal and financial advice before participating in any distressed asset purchase.
- Accurate Information: Provide truthful and accurate information when registering interest or contacting us.
5. Intellectual Property
All content on this platform, including the brand name "ghar.auction", logos, UI design, curated data structures, and proprietary research notes, is the intellectual property of ghar.auction. Any unauthorized scraping, reproduction, or commercial use of our data is strictly prohibited and will lead to legal action.
6. Prohibited Uses
You may not use the platform to:
- Harass bank officers or other users.
- Submit fraudulent leads or spam the advisory team.
- Bypass any security measures or rate limits.
- Reverse engineer our data aggregation systems.
7. Governing Law and Jurisdiction
These Terms of Service are governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra.
8. Changes to Terms
We reserve the right to modify these terms at any time. Significant changes will be notified via a banner on the platform or through email. Your continued use of the platform after such changes constitutes your acceptance of the new terms.
